Accused of a sexual offence: the first steps

What happens after an allegation, how the process works and what to do and not do in the early days.

What usually happens first

You may be arrested, or asked to attend the police station by appointment for an interview under caution. Your phone and devices may be seized. You may be released on bail with conditions, or released under investigation.

What not to do

  • Do not contact the complainant, directly or through friends or family, even to apologise or to explain. This can be treated as interference with witnesses and can lead to a further charge.
  • Do not delete messages, photographs or accounts.
  • Do not discuss the allegation on social media or with anyone other than your solicitor.

Anonymity

Complainants in sexual offence cases have lifelong anonymity by law. A suspect or defendant does not, and an allegation may be reported once a person is charged. That is one reason early specialist advice matters.

The interview

Take legal advice before any interview. A solicitor can ask for disclosure of the allegation in advance and advise on whether to answer questions, give a prepared statement or remain silent.
